Files lawsuit against late-singer's estate under Child Victim's Act

BUFFALO, N.Y. (WBEN) - An anonymous woman claimed she was raped by singer Rick James in 1979 and is suing the estate of the late-singer under the Child Victim's Act.

In a lawsuit filed Thursday in Erie County Supreme Court, the woman claims James raped her when she was 15 years old and living in a group home. She said she did not know who James was.


"Almost immediately, Rick James was very suggestive and inappropriate towards me," the woman said in the lawsuit "He made me feel very uncomfortable."

She then said in her affidavit that James entered her bedroom and swiftly laid on top of her, grabbed her hair and pushed her head into the pillow.

"I tried to fight him off, but he told me to 'shut up and quit moving or I'll cut you'," she said. "...He then threatened me that if I told anyone, he would know where to find me."

The woman claims to have everlasting damage as a result of the encounter.

James died in 2004. The Buffalo-born singer was laid to rest at Forest Lawn Cemetery.
