BUFFALO, N.Y. (WBEN) - Fourth of July is right around the corner and even though fireworks were illegal in the past, New York State legalized sparklers.

It came as a surprise to Erie County Legislator Joe Lorigo, who said counties had to opt in if they wanted to sell sparklers. Now that they're legal, counties would have to specifically opt out by banning them.
"We have not heard anybody crying out to ban these," Lorigo told reporters this week.

Sparklers have already been seen and purchased at area stores like Target, Wal-Mart, BJ's, and more.

According to a 2016 article by the Boston Globe, sparklers accounted for 22 percent of fireworks-related injuries. Firecrackers came in second with 16 percent. Burns are the most common injuries associated with sparklers. According to the Consumer Product Safety Commission, sparklers burn at temperatures of about 2,000 degrees, which is actually hot enough to melt some metals.

Around 250 people on average go to the emergency room every day with fireworks-related injuries in the month around the July 4 holiday.
