Report released regarding alleged rape by former Erie County commissioner

BUFFALO, N.Y. (WBEN) – An investigation by New York City-based Lemire Law Firm was released as it related to former Erie County Social Services Commissioner Al Dirschberger, who is accused of the rape of a subordinate at an Albany conference last December.

Dirschberger was forced to resign late last year by Erie County Executive Mark Poloncarz after the county executive learned of the investigation.

“My administration does not tolerate sexual harassment,” Poloncarz said at a press conference on Tuesday afternoon. “It does not tolerate allegations associated with those involved in the matter. As was thoroughly documented in the report, when we found out about it, we took action. On December 23, we investigated and commenced a number of matters that, by the time December 28 occurred, Mr. Dirschberger had resigned based on the allegations presented to us.”

The 103-page report found that no evidence of wrongdoing by the Poloncarz administration in regards to his hiring or their handling of the alleged incident.
