No Plea from Truck Driver Accused of Manslaughter

BUFFALO, N.Y. (WBEN) - Kristofer Gregorek did not enter a plea on Tuesday in Erie County Court.

The 27-year-old truck driver from Ballston Spa previously faced charges of Manslaughter in the Second Degree after he struck and killed Ellen Volpe, 45, on Interstate 90 between Depew and Pembroke last June 8. Investigators brought forth those charges because Gregorek reportedly was distracted while driving. He was allegedly shopping and completing a survey at the time of the fatal accident.

Volpe, a Rochester native, was an associate professor at the University at Buffalo School of Nursing.

He was previously arraigned in Town of Lancaster Court where he plead not guilty to the manslaughter charge. In Erie County Court, it was believed he would plead guilty but his attorney requested more time with her client and that Gregorek is expected to testify before a grand jury before a formal charge comes forward at the county level.

Gregorek's attorney would not speak to reporters following Tuesday's arraignment. No future court date has been made public.
