BUFFALO, N.Y. (WBEN) - Joseph Conti appeared in a City of Buffalo courtroom on Tuesday for a domestic violence matter.

Conti reportedly started the fire on Benzinger Street last Monday which took the life of his seven-year-old son, Anthony. He admitted to neighbors that he started the blaze while using a blowtorch to light a cigarette. Fire and homicide officials have not confirmed this and no charges have been filed against Conti as it relates to the fire.

Tuesday’s appearance regarded around a New Year’s Eve incident where he allegedly spit at his wife, Lisa. An order of protection was issued the next day.

Conti’s defense attorney wanted the charges to be dismissed on the grounds that it was a one-time incident and not a prolonged issue.

The judge in court said she wanted the motions in writing.

Conti will appear again in court on March 5 at 9:30 a.m.
