Buffalo, NY (WBEN) - A former Buffalo Police Officer who resigned from the force amid charges of civil rights violations was sentenced to three months in prison on Wednesday.

Eloff had previously pleaded guilty to deprivation of rights under color of law in federal court. In addition, Eloff formally resigned from his position as a Buffalo Police officer. He had previously been suspended from his position since the incident.

Eloff was working security for Molly's Pub when he grabbed a man identified as D.H., handcuffed and seated him next to Sager outside the bar. D.H. was later taken from the scene by other officers. Surveilance footage showed that Eloff caused D.H. to be falsely arrested for trespassing, a crime D.H. never committed.

Sager died three months after the incident from injuries he sustained after being pushed down a flight of stairs at the bar.

Following his prison sentence, Eloff will serve a three month term on home confinement.
