Family of Man Shot by Buffalo Police Files Notice of Claim

Attorney says Pito Rivera may never have been armed

Buffalo, NY (WBEN) The family of Pito Rivera, shot dead by Buffalo Police in September, has filed a notice of claim against the department and the city.

Rivera was fatally wounded September 12th as he was running down Plymouth Avenue. "We see him being shot and killed, and we do not see any firearm pointed at anybody. In fact, it's unclear if he has a firearm on him at all," says attorney Steve Cohen, referring to video from the scene.

Cohen he's irritated by how Buffalo Police were defending it. "If you see someone fleeing, whether or not one of our officers is in imminent danger, our policy is shoot the kill, they say, and that's absolutely frightening," contends Cohen.

Cohen has asked police of other improvements in the past. "We have asked them to become a certified police department, and the city wants nothing to do about it. This continue to repeat itself," says Cohen.

He says no matter what the judgment or settlement is, it cannot bring Rivera back.
