Moves comes after scalding state report

Buffalo, NY (WBEN) Earl Jann has been fired by the Erie County Water Authority. His contract was terminated during a board meeting Thursday.

The authority has come under fire after a report by the state Authorities Bureau Office found commissioners neglected fiduciary duty and were not transparent in their decision making.

The report showed board members approved a significant raise for a deputy director, without a performance review. 

Erie County Legislator Joe Lorigo believes this may be a distraction by the authority to the real issue. "Commissioner (Jerome) Schad has lost the confidence of the majority of the legislature and Erie County taxpayers," says Lorigo. 

Commissioner Jerry Schad explains Jann's contract was voidable, and was voided during Thursday's meeting. "One elected board cannot adopt and enter into a contract to govern the entity that reaches past their own term," says Schad. "The authority has three commissioners on staggered terms and that three year contract violates that term limits doctrine because it can reach beyond the term of any given majority at any given time."
