DWI crash leads to vehicular manslaughter charges

WEST SENECA, N.Y. (WBEN) - A man accused of drunk driving is now facing vehicular manslaughter charges after a woman died.

The Erie County DA's Office said Daniel Witczak of Orchard Park was arraigned Tuesday night and charged with the felony.

Witczak, 33, allegedly drove drunk at 5:30 a.m. on September 15 and crashed his car on Southwestern Boulevard. Police who responded to the scene found Witczak's car overturned 50 yards from the roadway. Witczak and two passengers were taken to ECMC with serious injuries. However, the crash killed 38-year-old Corrine Bennett.

The two surviving passengers continue to recover from their injuries.

The Orchard Park man was initially arraigned on a DWI misdemeanor in October. He was charged with the additional crimes following an investigation by the DA's office and by West Seneca Police. The DA's office said that Witczak waived his right to a felony hearing and his case will now be heard before a Grand Jury.

Witczak is not being held in jail for his alleged crimes.
