Buffalo, NY (WBEN) The woman who accuses former Erie County Social Services Commissioner Al Dirschberger of raping her has now filed a notice of claim against the county.

The woman, who goes by Jane Doe in the filing, contends Dirschberger raped her while at a conference in Albany December 5th-6th. Dirschberger was her supervisor as the two were attending a conference. She claims she was assaulted and raped repeatedly by Dirschberger, and as a result, suffered bruising, lacerations, mental pain and suffering and possible transmission of a sexually transmitted disease.

The claim notice contends the county was aware of prior sexual harassment or abuse by Dirschberger but never alerted her to it, and not doing anything about prior claims against Dirschberger.

Dirschberger was arraigned in Albany County Court in January on rape and criminal sex act charges.

He resigned from his post in December.
