Cannabis Legal in Canada; Still Illegal in US

Important information on returning to US after using marijuana in Canada

Buffalo, NY (WBEN) Wednesday marks the beginning of legalized recreational marijuana use in Canada. But, as an American citizen, there are important things to remember as you return from the Great White North.

Attorney Kelly Carr says the most important thing to remember is to keep the cannabis in Canada. "It's important they not bring any marijuana back because in the US, it's still illegal," reminds Carr. 

Carr notes if a Canadian citizen comes to the US and the inspector smells marijuana, that person will be referred to a secondary inspection to see if there's any possession or that person is just under the influence. "Possession of marijuana is prohibited in the US. Use is a bit of a gray area for US citizens," says Carr. Getting charged could hurt your chances of returning in Canada. "If you are a US citizen and you have a drug charge, you would have to discuss with a Canadian immigration expert as to how this would affect your admissibility into the country."

Carr says if a person is driving under the influence, that could also be a problem, especially when returning to the US.
