BPD Arrest in Fatal August Crash

Driver charged with vehicular manslaughter

Buffalo, N.Y. (WBEN) - Buffalo Police have arrested the driver of a vehicle involved in a rollover crash that killed a woman in August. 

A 27 year old Buffalo man is charged with Vehicular Manslaughter and DWI in connection with the death of a 42 year old Buffalo woman in the early morning hours of August 3rd.

Investigators say the two were in the same vehicle, a 2003 Chevrolet Trailblazer, just before 6am when the vehicle that the defendant was driving struck a tree in the 300 block of Memorial Drive. Police say the vehicle was traveling northeast on Memorial Drive when it left the roadway, struck a large tree and then flipped over.

Accident investigators say a passerby witnessed the crash and attempted to render assistance to the two individuals in the vehicle when authorities say the driver exited the vehicle and attempted to flee on foot.

Police say because of the injuries the defendant suffered in the accident he fell to the ground a short distance away from the vehicle.

First responders extricated the female passenger, 42 year old Toni Abernathy of Buffalo from the vehicle but she was declared dead at the scene.

Accident investigators utilized state of the art technology to fully document the scene and measure the actions of the vehicle.

Additionally, Investigators determined that the Chevy Trailblazer was traveling more than 25 miles per hour over the posted 30 mph speed limit at the time of the accident.

After months of investigation, police located the defendant at an East side address.

27 year old Tremayne D. Brooks of Buffalo was arrested and charged him with Vehicular Manslaughter,  DWI by alcohol and impaired by drugs, Aggravated Unlicensed operation of a vehicle, imprudent speed  and failure to keep right.

Investigators say that Brooks had a BAC of .14 at the time of the incident.
