Buffalo, NY (WBEN) Gabrielle Ballowe, who admitted to fatally hitting a man and driving off in 2013, has been denied early release.

Erie County DA John Flynn says the Erie County Department of Probation’s Conditional Release Commission has denied the 51 year old's request. Ballowe is currently serving a one year sentence for Leaving the Scene of an Incident Without Reporting Resulting in Serious Physical Injury.

Flynn says Ballowe applied for early release under a program that allows offenders sentenced to a year in jail or less to serve the remainder of their term in the community under the supervision of the Erie County Department of Probation.

“Ms. Ballowe committed a serious crime and in response to her request, our office vehemently opposed any opportunity for her to avoid serving her full sentence,” says Flynn. “We commend the Erie County Department of Probation for making the right decision.”

52-year-old Barry Moss of Evans died December 22, 2013, when Ballowe struck him along Route 5 in Evans and then drove off.
